Terms and Conditions of Sale

These terms and conditions apply to all sales transactions between ‘North Hill Soap Company’ and an persons or company (‘the purchaser’) placing an order for the manufacture and/or the supply of any goods (‘the goods’). North Hill Soap Company by accepting any order for Goods from the Purchaser agrees to sell and the Purchaser agrees to purchase such Goods at the price stated on North Hill Soap Company’s website or order form and on the sole basis of the terms and conditions of North Hill Soap Company stated herein.

1. Purchasing Goods
When purchasing goods on this Website you warrant that the personal information which you are required to provide when you register as a customer is true, accurate and current in all respects. If your personal information changes then please notify us immediately by contacting us at 416-998-0832 or via email info@northhillsoap.com.
You place your order request for goods from the website by clicking on the confirm order button at the end of the on-line order process. You will be guided through the process of placing an order by a series of simple instructions on the website.
Once you have placed your order, you will receive an acknowledgement providing you with a payment reference and the value of your order which has been debited to your credit/debit card via Paypal.

2. Returns and cancellations
Unless we have notified you that we do not accept your order or you have cancelled your order, our acceptance of your order and the completion of the contract between you and us will take place when we have dispatched the goods ordered by you. To cancel your order after it has been dispatched to you, you will need to follow the returns policy and procedure.
Returns Policy and Procedure:
If for any reason you are not happy with your purchase once you have received it please contact us at the earliest opportunity at 416-998-0832 or email info@northhillsoap.com. The soap must remain unopened and in its original packaging and returned to us at your own cost to: North Hill Soap Copmany, 103 St Michaels Cres, Bolton ON, L7E5Y6.

We may not accept your order if an item you have ordered is out of stock, we are unable to obtain authorisation for your payment or if we identify a product or pricing error. We reserve the right to reject any offer to purchase by you at any time. We do not routinely offer substitutes when the product you have ordered becomes unavailable. Should this occur for any reason we will contact you on the contact details provided by you at the earliest opportunity, and we may offer another suitable alternative if you wish.

If we are unable to fulfil your order for any reason we will contact you by email or telephone.

3. Cancellations
Please contact us by telephone or email at the earliest opportunity in order to cancel your order. If by some reason you are unable to contact us and we have dispatched your order we will consider each case individually. The goods must be returned unopened in their original packaging and packed in such as a way that they cannot be damaged in the postal process.

4. Complaints and Customer Service
The Purchaser should inform North Hill Soap Company immediately of any problems at 416-998-0832, or info@northhillsoap.com. Complaints are taken very seriously by North Hill Soap Company and will be dealt with within 5 working days, although most complaints can be dealt with within a few hours. Please note that the Purchaser is also welcome to contact North Hill Soap Company on any issue relating to their order on the contact telephone, or email listed above. North Hill Soap Company operating hours are from 09:00 EST to 17:00 EST, Monday to Friday.

5. Customer Privacy
North Hill Soap Company collects the information provided by the Purchaser at the time of ordering and uses this information lawfully and in accordance with the Data Protection Act 1998. Information is collected by North Hill Soap Company to process the Purchaser’s order and also to provide the highest level of customer service possible.
North Hill Soap Company does not sell or pass customer’s e-mail addresses or other details to other parties. If you order from us, we may contact you about your order and we may, on occasion, e-mail or write to you with information about our products and special offers.

6. Pricing
Prices for goods include standard packaging. The price does not include the delivery of the order to the Purchaser. This is an additional cost, unless otherwise stated. We will take all reasonable care to ensure that all details, descriptions and prices of products appearing on the website are correct at the time when the relevant information was entered onto the system. Although we aim to keep the website as up to date as possible, the information including product descriptions appearing on this website at a particular time may not always reflect the position exactly at the moment you place an order.

7. Secure Ordering and Payment
All our orders are processed through Paypal. You do not have to have a Paypal account to make a payment through Paypal, you can make a one off payment with many major debit or credit cards. We cannot be held responsible for any issue relating to Paypal and the payment process, this needs to be dealt with directly with Paypal on their customer services number. North Hill Soap Company will of course do our utmost to assist you where possible.

Payment can be made via Paypal by any major credit card and will be debited and cleared from your account before the dispatch of your goods. All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to, or subsequently refuses to, or does not, for any reason, authorise payment via Paypal to us, we will not be liable for any delay or non-delivery. You confirm that the credit or debit card that is being used is yours.

If for any reason you wish to make payment to us by any other means please contact us and we will assist you with this. It may also be possible for us to arrange an invoice to be sent to you allowing you to pay us by cheque. This may of course delay the shipment of your ordered goods as we retain the right not to deliver goods until payment has been received in full along with any postage fees.
We will retain the legal ownership of the goods until full payment has been made by you and such payment has been received by us. Legal ownership of the goods will immediately revert to us if we refund any such payment to you.

Goods will only be despatched once payment has been received in full.

8. Delivery
We will make every effort to despatch orders within 5 working days of receipt of payment. Orders are usually sent out Canada Post Expedited Parcel or Priority Mail USA unless discussed with us and shipped within 24hours of order, but in some rare cases it may be more than 48hours. Our flat rate prices listed on the website include a 2-5 business day delivery service within Canada, and 5-10 business day delivery to the US. Deliveries internationally will vary depending on location and shipping method chosen – please email us for a quote. All international orders will be treated separately.
North Hill Soap Company does not accept any liability whatsoever for delayed delivery caused by any third party. As soon as you have received the goods, you will assume all risk in the goods. Upon delivery of the goods to you, we will also provide you with sufficient details to enable you to:

a) exercise your right of cancellation; and
b) address any intended cancellation or complaints to the correct place of business.
If you have not received the entire order as detailed in the order confirmation email sent to you when an order is received, please contact North Hill Soap Company.

9. Product and Product Variations
Please bear in mind that our handmade range of products are genuinely hand-made in small volumes so you may encounter some variation in colour, texture, scent or wrapping between batches or orders and as they are pictured on this site or in any other marketing materials. If you do have any problems or queries, please let us know. We attempt to be as accurate as possible when describing products on the website; however, to the extent permitted by applicable law, we do not warrant that product descriptions, on the website are accurate, complete, reliable, current, or error-free.

10. Samples
Unfortunately we cannot routinely provide samples of our soap as we are a small company. However, if in the case where someone wishes to try our soap for suitability we may provide a small sample at the postage cost of the person requesting the sample. We retain the right to refuse this service at any time.

11. Website
All content available on the website, including, but not limited to, text, graphics, logos, button icons, images, data compilations, and software, and the compilation thereof (the “Content”) is the property of North Hill Soap Company, our affiliates, our partners or our licensors, and is protected by Canadian and international copyright laws. Nothing may be reproduced in whole or part by electronic means or in print without the prior written permission of the company.

We are not responsible for the content of any off-Website pages or any other websites linked to or from the Website.

12. Force Majeure
North Hill Soap Company will exercise every reasonable effort to meet the requested dispatch date. North Hill Soap Company shall not, however, be liable for any loss or damage due to delays or failure to ship resulting from any cause beyond its reasonable control, such as but not limited to compliance with laws or regulations, acts of God, acts or omissions of the Purchaser, acts of civil or military authority, judicial action, defaults of sub-contractors or suppliers, labour disputes, failure or delays in transportation, embargoes, wars or riots.

13. Insurance and Legality of Selling
We are insured as a craft seller of handmade soap as required by law.  Our products have also been notified via the CNF (Cosmetic Notification Form) to Health Canada.  We are also affiliated with the the Handcrafted Soap & Cosmetic Guild (http://www.soapguild.org/).

14. Jurisdiction and Contact details
These terms and conditions shall be governed by and construed in accordance with relevant Canadian law and the relevant courts of the Canada will have exclusive jurisdiction in relation to the Agreement.
None of the above terms affect your statutory rights as a consumer.
